General Terms and Conditions (GTC) of Yaha-Yahui.com
1. Scope of Application
The following General Terms and Conditions (GTC) apply to all orders placed via our website. The offer on this website is aimed exclusively at consumers residing in Switzerland and the Principality of Liechtenstein (hereinafter “Customer”). Yaha-Yahui.com reserves the right to amend these GTC at any time. The version of these GTC valid at the time of the order shall apply, which cannot be changed unilaterally for this order. Any terms and conditions of the customer that conflict with or deviate from these GTC shall not be recognized. The operator of this website is ANKAL Trading GmbH.
2. Information on This Website
Yaha-Yahui.com contains information about products and services. Prices, product ranges and technical specifications are subject to change without notice. All information on Yaha-Yahui.com (product descriptions, images, illustrations, films, dimensions, weights, technical specifications, accessory relationships and other information) are for illustrative purposes and are to be understood as approximate values and are non-binding. In particular, they do not constitute an assurance of properties or guarantees, unless explicitly stated otherwise. Yaha-Yahui.com makes every effort to ensure that all details and information on this website are correct, complete, up to date and clearly laid out.
3. prices
The sales prices stated on Yaha-Yahui.com are final prices and, unless otherwise stated, include statutory VAT, spirits tax and any other statutory charges such as advance recycling fees (VRG) or copyright levies for electronic devices. Prices are quoted in Swiss francs (CHF).
Any shipping costs will be charged additionally, unless otherwise specified, and must be paid by the customer. Shipping costs are shown separately in the order process.
Yaha-Yahui.com reserves the right to make technical changes, errors and misprints, and in particular to change prices at any time without prior notice. Consulting and support services are not included in the sales prices.
4. Conclusion of Contract
The products and prices on this website are non-binding offers.
By placing an order via this website, including acceptance of these GTC, the customer makes a legally binding offer to conclude a contract. Yaha-Yahui.com then sends an automatic order confirmation by email, which confirms that the customer's offer has been received by Yaha-Yahui.com. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.
The contract is concluded as soon as Yaha-Yahui.com sends a declaration of acceptance by email, confirming the dispatch of the ordered products or services.
Orders will only be shipped after full payment has been received (exception: delivery against invoice) and if the goods are available. If it transpires that the goods ordered cannot be delivered or cannot be delivered in full, Yaha-Yahui.com is entitled to refuse to accept or fulfill the order, or to do so only partially. In such a case, Yaha-Yahui.com will inform the customer by email. If the customer's payment has already been received by Yaha-Yahui.com, the payment will be refunded to the customer. If no payment has yet been made, the customer will be released from the obligation to pay.
5. Payment Options and Retention of Ownership
The customer has the payment options specified in the order process at his disposal.
Yaha-Yahui.com reserves the right to exclude customers from individual payment options without giving reasons or to insist on payment in advance.
Yaha-Yahui.com may charge default interest of 5% per year and a reminder fee of a maximum of CHF 20 per reminder if the customer is in default of payment.
The products delivered to the customer remain the property of Yaha-Yahui.com until full payment has been made.
6. Delivery, Obligation to Inspect, Notice of Defects and Returns
Deliveries are sent by post or courier service to the address specified by the customer in the order.
Yaha-Yahui.com endeavors to keep delivery times as short as possible. However, any delivery times stated in the order confirmation are non-binding. Yaha-Yahui.com is entitled to make partial deliveries. In this case, the customer will only be charged the shipping costs once.
If delivery against invoice is offered, the invoice will be sent by email or post at the discretion of Yaha-Yahui.com.
If the delivery cannot be delivered or if the customer refuses to accept the delivery, Yaha-Yahui.com may terminate the contract after notifying the customer by email and granting a reasonable grace period, and may charge the customer for the costs incurred.
The customer is obliged to inspect the delivered goods immediately upon receipt of the delivery and to report any defects for which Yaha-Yahui.com is liable immediately in writing by letter or email to the address in the legal notice.
Returns to Yaha-Yahui.com are at the expense and risk of the customer. The customer must send the goods in their original packaging, complete with all accessories, together with the delivery bill and a detailed description of the defects to the return address specified by Yaha-Yahui.com.
If the inspection by Yaha-Yahui.com reveals that the goods have no detectable defects or that they are not covered by the manufacturer's warranty, Yaha-Yahui.com may charge the customer for the costs of the return shipment or any disposal.
7 No Sales to Minors
In Switzerland, the Principality of Liechtenstein, and EU alcoholic beverages may not be sold to minors under the age of 16, and spirits may not be sold to minors under the age of 18. By placing an order on Yaha-Yahui.com, the customer acknowledges these provisions and confirms that he/she is authorized to make the purchase. Yaha-Yahui.com declines all liability in the event of non-compliance.
8. Warranty
Yaha-Yahui.com endeavors to deliver goods of impeccable quality. In the event of defects reported in good time, Yaha-Yahui.com guarantees that the item purchased by the customer is free of defects and functional for the statutory warranty period, which is generally two years from the date of delivery. It is at the discretion of Yaha-Yahui.com to provide the warranty through free repair, equivalent replacement or reimbursement of the purchase price. Further warranty rights are excluded.
The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties, or defects caused by external circumstances. The warranty for consumables and wearing parts (e.g. batteries, accumulators, etc.) is also excluded.
Yaha-Yahui.com is unable to give any assurances or guarantees for the topicality, completeness and correctness of the data or for the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks and other content. In particular, no representation or warranty is given that the use of the website will not infringe rights of third parties not owned by Yaha-Yahui.com.
9. Liability
Yaha-Yahui.com excludes all liability, irrespective of its legal basis, as well as claims for damages against Yaha-Yahui.com and against any auxiliary persons and vicarious agents. In particular, Yaha-Yahui.com is not liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage or pure financial loss suffered by the customer. This is without prejudice to any further mandatory statutory liability, for example for gross negligence or unlawful intent.
Yaha-Yahui.com only uses hyperlinks to simplify the customer's access to other websites. Yaha-Yahui.com cannot know the content of these websites in detail, nor can it accept any liability or other responsibility for the content of these websites.
10. Partial Invalidity
Should individual provisions of these GTC prove to be invalid or unenforceable or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.
11. Further Provisions
Yaha-Yahui.com expressly reserves the right to amend these GTC at any time and to bring them into force without prior notice.
In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict of laws rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
The place of jurisdiction is St. Gallen, Switzerland.
